Q.: What is Bankruptcy and how can it help me?
A.: Bankruptcy is a type of relief provided by federal law under the U.S.
Bankruptcy Code to allow some or all of your debts to be discharged so
that you are no longer responsible for those debts. Bankruptcy may help
you wipe out your debts and get a fresh start with your financial affairs.
Q.: What is the difference between Chapter 7 and Chapter 13 bankruptcy?
A.: Chapter 7 bankruptcy, in general, wipes out all of your unsecured debts.
Chapter 13 bankruptcy puts you on a payment plan for 3—5 years to pay back
the debts you can afford to pay back based on your “disposable monthly
income”. Anything left unpaid at the end of the payment period will be
discharged and you a chance at a fresh start..
Q.: Will I lose my house, car or property?
A.: In general, if you are financing a house, car or other property, you may
keep that property as long as you are current on your payments. Property that
you own outright or in which you have equity can be protected to the extent
provided for by state or federal exemptions, as applicable.
Q.: How much does bankruptcy cost?
A. The court filing fee for Chapter 7 is $299 and for Chapter 13 is $274.
Attorney’s fees vary from case to case. Only $100 retainer can secure you the
